Brooke Carol Wilberger (February 20, 1985 – May 25, 2004) was an American student from the state of Oregon who was abducted and later murdered. Her disappearance was covered by the national media, and hers was one of the most publicized murder investigations in Oregon history.[1][2]

Wilberger was born in Fresno, California, on February 20, 1985 to Greg and Cammy Wilberger. She had three sisters and two brothers.[citation needed] Described as a devout Mormon, Wilberger was a graduate of Elmira High School near Eugene, Oregon.[3] She had just completed her freshman year at Brigham Young University in Provo, Utah, at the time of her abduction.[3][4] During that time, her boyfriend, Justin Blake, was serving as a Mormon missionary in Venezuela.[5]
Abduction

Wilberger was abducted from Corvallis, Oregon, on the morning of May 24, 2004, by Joel Patrick Courtney.[1] He drove her into the woods outside of town. He returned to town to buy food while he still had Brooke bound in his van. He kept her alive throughout the night before raping her the next morning. He bludgeoned her to death when she tried to fight off the rape.[1] At the time of her disappearance she was on summer break, visiting and working for one of her sisters in Corvallis.[citation needed] She was last seen cleaning lamp posts in the parking lot of the Oak Park Apartments, which her sister and brother-in-law managed, on the edge of the Oregon State University campus.[6]

When Wilberger disappeared, the police began investigating immediately – against normal procedure. Lt. Ron Noble of the Corvallis Police Department said, "Normally, we would wait. Because adults can come and go as they please, and we would normally wait to see if she showed up maybe the next day." However, in this case, police officials agreed with the family that Wilberger was not the type of girl to disappear on her own.[5] The Wilbergers' church organized a search by citizens of Corvallis.[5]

Wilberger's remains were found on September 21, 2009, more than five years after she disappeared. The man accused of her murder, Joel Courtney, revealed the location of her remains as part of a plea agreement to avoid the death penalty. He pleaded guilty to aggravated murder, the only crime subject to capital punishment in Oregon, and was sentenced to life in prison without the possibility of parole.[7]

On November 30, 2004, a University of New Mexico student was beaten and raped, before escaping and identifying Joel Patrick Courtney as her abuser. On September 12, 2007, Courtney pleaded guilty to the beating and rape of the 22-year-old University of New Mexico foreign exchange student. Courtney's plea agreement called for a prison sentence of up to 18 years, plus five to 20 years on parole.[9] Courtney also had to register as a sex offender.[10] Police eventually linked Courtney, a native of Beaverton, Oregon, to the disappearance of Wilberger and in August 2005 he was charged on 19 counts of aggravated murder, kidnapping, sexual abuse, rape and sodomy.[11] Court documents released in 2008 revealed details showing that Courtney was in Corvallis when Wilberger disappeared and that the green van he was driving was spotted by several people, including an OSU employee who identified him from a photo lineup.[12] Officials said that Wilberger's DNA was found inside the van, along with her hair.[13]

Courtney was extradited to Benton County, Oregon, for the Wilberger case on April 8, 2008.[14] He was scheduled for his first appearance on April 9, 2008, at the Benton County Courthouse,[15] facing 14 counts including aggravated murder, two counts of kidnapping and single counts of rape, sodomy and sexual abuse in connection with Wilberger's disappearance. Charges were filed despite the absence of the body of the alleged victim at the time; the prosecutor in the case announced that he would seek the death penalty.[16]

The FBI briefly considered Courtney a suspect in two to three disappearances under investigation but have since eliminated him as a suspect.[17] The case was covered several times on the television program America's Most Wanted.[18]

Courtney's attorneys worked towards a trial, as well as towards a speedier resolution. The trial was set for February 1, 2010.[19] He was expected to be charged in connection with the unrelated kidnapping, attempted sexual assault, attempted rape, attempted sodomy and attempted murder of two Oregon State University students, the same day Wilberger went missing.[14]

On September 21, 2009, Joel Patrick Courtney pleaded guilty to aggravated murder and was sentenced to life in prison without the possibility of parole for Wilberger's death. The deal spared Courtney from the death penalty, in exchange for providing information about the location of Wilberger's body.[1] In addition, the deal also called for Courtney to be imprisoned in his home state, New Mexico, instead of Oregon where the crime was committed.

The Benton County District Attorney announced the recovery of Wilberger's body (without specifics or its location) in a press conference the day of Courtney's confession.[20] Wilberger's remains were found on private property in Benton County in the Oregon Coast Range.[2][21]

first this case was linked via behavioral case linkage analysis, Joel Patrick Courtney attempted and almost successfully abducted a Russian 19 white female student in broad daylight, but she managed to escape. In New Mexico 1400 miles away several months later. He was identified and as Brooke was still in the news, the New Mexico police thought he might be connected to Brooke in Oregon based on victimology, MO and signature.

here's the relevance, the forensics that was used to convict Joel Patrick Courtney.

Eye witnesses did say they saw a whilte male matching Joel Patrick Courtney near location and time when Brooke disappeared driving a green van.

the FBI took the vehicle, and it was clear it was meticulously cleaned. they obviously found Joel Patrick Courtney DNA via touch DNA inside his own vehicle which should come as no surprise since he drove it.

now Joel Patrick Courtney denied having anything to do with the abduction of Brooke Willberguer.

In prison in New Mexico, detectives asked him if he abducted Brooke and he laughed. Joel knew that without a body or any evidence, there's nothing to connect him to Brooke's abduction and murder.

the FBI forensics carefully went over every square milimeter in the fan.

they found a   strand of blonde hair in the van according to the documentary. DNA testing of the the strand of hair matched Brooke's.

faced with this forensic evidence Joel Patrick Courtney confessed.

is there an objective scientific basis to state that finding a single strand of Brooke's hair in Joel's van is evidence Brooke was in Joel's van, but that finding multiple types of unsourced fiber + hair + shoe print + unsourced ligatture and tape + dna + ransom note is not evidence another person was present in Jonbenet's home?

its clear RDI are a lynch mob and anti-science anti-forensics who use a very different standard than what real forensic scientists employ, which make them a lynch mob. they are in effect special pleading that what is evidence of an intruder is not, and promote misinformation in sites like websleuth topix forumsforjackass

that brooke was in joel's van is not in doubt but they did NOT find fingerprints of brooke, nor shoeprints, nor fibers, no tDNA.

some other thoughts

brooke is an example of missing white woman syndrome.
brooke was reported missing immediately as soon as her sister realized brooke was missing she immediately called 911, possibly within minutes after her abduction from the parking lot.

Brooke and her family were devout mormons christian and they prayed but god didn't save brooke's life.  the mother and sisters did say they think Jesus answered their prayers in that her killer was caught and agreed to show where her body was so brooke could be buried as a christian.

brooke's mom and sister feel that jesus answered their prayer.

the prayer of brookes family and community was that brooke is found alive and unharmed yet jesus and god didn't answer that prayer.

IMO if their belief jesus answer their prayer helps them psychologically i supposed whatever.

brooke was described as a good person, drug free and wanting to go places. so i guess jesus and religion might have some value in that sense. i'm not mentioning any names but i know of someone who like brook is a white female 19 around same age who were into drugs with a very different outcome.

i'm not mentioning any names but brooke strong mormon christian values did prevent her from getting involved in drugs and kept her happy and productive, with strong family who immediately called police when she went missing.

but it didn't actually prevent her from being abducted by a sexual predator or save her life. it did create a huge community of mormon volunteers looking for her and prayer circle.

religion kept brooke out of trouble with drugs but its hard to believe there is some deity who protected her from harm.

i don't know if knowing and learning judo since age 5 would have helped Brooke Wilberger but not knowing any self defense led to her death.

i'm not sure what the best martial arts is to learn but some combination of striking and grappling, knife defense

IMO schools should teach some form of self-defense starting from kindergarten, though the specific mix of punching kicking grapping i'm not sure. plenty to choose from

Circumstances of Disappearance: Unknown. Brooke had been visiting family in Oregon while she was on summer break from college in Utah. She was last seen by a family member doing maintenance in the Oak Park Apartments parking lot near the 1200 block of SW 26th St.

Joel Patrick Courtney gave his account. the documentary had a dramatization/ recreation of the event. he drove around saw brooke alone in a parking lot. he drove up in his van. he hopped out. briefly asked her a question then immediately grappled her and held a knife and took her to his van and drove off. all in broad daylight. in the middle of the day, near an apartment complex. and no one saw it as it happened. just minutes later brooke's sister and friend were where they last saw brooke, saw her sandals there and immediately called police. after raping and killing brooke he hid her body and scrub his van of all evidence. they didn't even find brooke's fingerprints in his van.

this can also show how other missing persons may have been abducted from OCCK to any missing persons.

i think if brooke resisted joel could have stabbed her and then drove off, leaving her to die.

i wonder if juijutsu or judo could have helped brooke or anyone threatened with a knife like brooke was.
