The case was built mostly on DNA evidence, including what prosecutors said might have been tears that the Stanton girl shed in her killer's car.
DNA provided the most powerful evidence of Avila's guilt. Tests showed an overwhelming likelihood that his DNA was present in material found under the girl's fingernails, which prosecutors theorized got there as she fought him during the attack. Tests also suggested that Samantha's DNA was on the passenger-side door of Avila's 1994 Ford Thunderbird, presumably from her tears, prosecutors said, as he drove her around Southern California.
Avila's attorneys had said he was in a Temecula motel room all night, hoping that a girlfriend he had been fighting with would stop by to reconcile. Crime lab scientists misinterpreted the DNA evidence, the lawyers said, and they contended that Samantha's genetic material had been planted in their client's car.
Prosecutors dismissed the defense's claims as "distractions."

ultimately its' what the forensic DNA experts think, as only their opinions constitute expert witness testimony, and their testimony is the best explanation is its the perp's DNA, not factory worker sneeze or secondary transfer.
the DNA they recovered in the car was not semen or blood. and while Samantha was there, there is no report of DNA or shoeprint or fingerprint of Samantha in the car. Just her DNA. they think it was her tears but it could be sweat or saliva as well.
RDI are a lynch mob. they do not apply the same scientific standards that are used in other cases to this case, which is what science and justice requires. in this case whatever the uneducated uniformed opinions of RDI on various forums websleuth topix crimeshots justicequest and from posters like cynic or ukguy or tricia griffith koldkase andrewww whoever does not matter. they are not expert witnesses. the expert dna witness have spoke and their conclusion is intruder. the tDNA that is evidence used in other cases in this case establishes an intruder theory. if you are going to "deny" tDNA in Jonbenet case, then hold yourself to the same standards and free every killer convinced with tDNA.
